- You agree that you have the right, authority, and capacity to enter into the agreement represented by these Terms and to abide by all of the terms and conditions of these Terms
- Nothing in the Terms affects any legal rights that you are entitled to as a consumer under the substantive jurisdiction’s law which cannot be contractually altered or waived
- You acknowledge that if we believe that any items in your account were received in connection with any fraud or other unfair dealing, we may delete items from your account or suspend and/or in cases, cancel your account without recourse or prejudice
- if we decide for any reason or no reason at all that it is in our best interest, we may delete items from your account or suspend and/or in cases, cancel your account without recourse or prejudice
- you will be bound by any additional rules or policies published within or with respect to the Service
- except as expressly permitted, you will not copy, redistribute, publish or otherwise exploit material from the Service without the express prior written permission from us
- you will ensure that your account information (the information you provided when you registered for with us remains current, complete, accurate and truthful
- You agree that all accounts are non-transferable, and any rights to them terminate upon the account holder’s death. You can change or correct your account information at any time
- you are responsible for all activity that happens on or through your account. To protect your account, keep your password confidential. Do not reuse your account password with other services
- Without prejudice to your statutory rights, if you forget your password and otherwise cannot validate your account to Broadcast Media Africa (BMA) or any of its affiliate websites/platforms, you acknowledge and agree that your account may be inaccessible to you and that all data associated with the account may not be retrievable.
- Limitation of Liability. In no event shall Broadcast Media Africa (BMA) be liable for any incidental, consequential, indirect, or punitive damages (including but not limited to lost profits) regardless of whether such liability is based on breach of contract, tort, strict liability, breach of warranties, failure of essential purpose or otherwise and even if advised of the possibility of such damages.
- You shall comply with all laws and regulations applicable to this Agreement and the performance of its obligations, and that it shall exercise due care and act in good faith at all times in the performance of its obligations hereunder. The provisions of this Section shall survive termination of this Agreement.
- Any notice required or permitted by this Agreement shall be in writing and shall be delivered by electronic mail of other forms of online communication.
- You shall irrevocably submit to the exclusive personal jurisdiction of the courts located in England and Wales for any matter arising out of or relating to this Agreement.
Privacy - How We Use Data & Information You Give Us
- We will use your information to accept you as a new/returning customer, to authenticate you when you attempt to register a new account with us, or to log you into your account.
- We also use it to provide you with our products and services.
- To let you know about significant changes to our products, terms or privacy policy
- We will use your information to process the payments when you transact on our websites and platforms and for the collection of any future payments or overdue amounts for those services
- We will use your information to be able to provide and improve the customer support we provide to you (e.g. when you have questions or when you forget your log-in information)
- We will use the information you share with us to comply with the law. When we share any information with our trusted partners, the information that we will share would include your name, company, job-titles and email address.
- To help us promote our services, where you have agreed to, we will use data about you to help us optimise the adverts we display online on third party websites and social media platforms. We use tools provided by social media platforms, advertising networks and search engines including Google, Facebook and Bing to optimise our advertising on their and third-party websites
- We work with partners who help us generate visitors to our website. Typically the information we share will just be a reference code they sent to us and details of whether you completed a desired action (such as signing up for a free account) but the partner will not be able to identify you or your device unless they already hold information about you as a result of their relationship with you.
- Complaint and dispute resolution: if you do complain to us, we will use the information we have about you to help us manage your complaint.
